The International Longshore and Warehouse Union (ILWU) and International Container Terminal Services Inc. (ICTSI) Oregon have announced an agreement to resolve all legal issues.
The settlement in ICTSI Oregon, Inc. v. International Longshore and Warehouse Union, et al., Case No. 3:12-cv-1058-SI, pending in the United States District Court for the District of Oregon, resolves ICTSI’s claims against ILWU.
During the case, the jury reportedly determined that ILWU and ILWU Local 8 engaged in unlawful labour practices.
The dispute, which was scheduled for a retrial on damages, was postponed by the filing of bankruptcy suits by the ILWU and Local 8 on 30 September 2023 and 18 October 2023, respectively.
Under the terms of the settlement, ICTSI will obtain $20.5 million.
The ILWU settlement arises from the parties’ participation in several days of mediation during ILWU’s chapter 11 bankruptcy case, which will be voluntarily dismissed as part of the terms of the settlement.
In July 2023, US West Coast port union workers refused to operate on containerships that were diverted from the striking ports in Canada’s West Coast.
Two months later, ILWU and the Pacific Maritime Association (PMA) ratified a six-year contract.
